Designs, Logos, and Uploaded Artwork

When you upload a logo or design, you confirm that you own the rights to the design or have permission from the rightful owner to use it for embroidery purposes.

We do not claim ownership of your uploaded designs. You retain all rights to your artwork.

We reserve the right to decline any logo or design that is unlawful, offensive, copyrighted without authorization, or otherwise inappropriate.

Orders and Production

All orders are processed based on the information and files you provide. It is your responsibility to double‑check spelling, colors, sizes, thread selections, file uploads, and any other details before finalizing your order.

Production timelines can vary based on workload, supply availability, and design complexity. While we make every effort to meet deadlines, we cannot guarantee specific delivery dates.

Changes to orders after submission may result in delays or additional charges.


Pricing and Payments

Prices listed on the website are subject to change without notice. Payment is required before production begins unless otherwise arranged.

We are not responsible for any additional fees charged by your bank, payment processor, or credit card provider.


Refunds, Cancellations, and Returns

Because embroidery involves custom work, refunds or cancellations may be limited.

We may offer refunds or corrections only in cases where an error is clearly the result of our production process.

We cannot refund or replace items due to:

  • design inaccuracies caused by incorrect information provided by you
  • dissatisfaction with thread color, sizing, or placement when the proof was approved
  • normal variations inherent to embroidery work

Custom products cannot be returned unless defective.


Copyright and Intellectual Property

All website content—including text, images, graphics, and digital materials—is owned by us or used under license. You may not reproduce, modify, or distribute any website content without written permission.

Your uploaded designs remain your intellectual property.


Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages resulting from your use of our website or services.

This includes damages related to:

  • delays in production or shipping
  • loss of data or uploaded artwork
  • technical issues or website outages
  • errors caused by incorrect information provided by you

Your sole remedy for any issue with the service is limited to correction or replacement of the affected product where appropriate.

Our website may use third‑party tools or integrate with external services such as payment processors or shipping carriers. These third parties operate under their own policies, and we are not responsible for their actions or practices.

Return and Refund Policy

Refund & Return Policy for Embrogear

We appreciate your business and take pride in producing high‑quality custom embroidery work. Because each order is made specifically for you, all products are considered custom items and follow the policy outlined below.


Custom Order Policy

All embroidery products are made to order using the designs, files, and information you provide. For this reason, custom items are not eligible for standard returns or refunds unless an error occurs on our part.


Eligibility for Refunds or Replacements

We may provide a refund, remake, or correction only in cases where an issue is clearly caused by our production process. Examples may include:

  • Incorrect thread color when it differs from the approved proof
  • Wrong design placement not matching the proof
  • Embroidery significantly different from the approved design
  • Damaged or defective items upon arrival

To qualify, issues must be reported within [X] days of delivery (you can choose 3, 5, 7, or 14 days). Photos may be required.


Issues Not Eligible for Refunds or Returns

We cannot provide refunds or replacements for the following:

  • Errors in spelling, colors, or details that match the proof you approved
  • Low‑quality or incorrect artwork files submitted by the customer
  • Slight variations in color, thread texture, or stitch appearance common in embroidery
  • Changes requested after production has begun
  • Customer dissatisfaction with design choices they approved
  • Minor sizing or placement variations within industry norms
  • Items damaged by the customer after delivery

Custom embroidery involves handcrafted work, and small variations are considered normal and acceptable.


Order Cancellations

Orders may only be canceled before digitizing or production begins. Once work has started, cancellations are not possible due to the custom nature of each order.

If materials have been purchased specifically for your job, cancellation may not be eligible for a refund even before production.


Shipping Issues

We are not responsible for:

  • delays caused by carriers
  • packages lost due to incorrect addresses provided by the customer
  • weather‑related or carrier‑related disruptions

If a package is lost or damaged during transit, we will assist in filing a claim with the carrier.



Digitizing Fees

Digitizing fees (if applicable) are non‑refundable once work has begun, even if the order is canceled or modified afterward.
